Motorists in Pennsylvania are forced to submit to a blood draw any time a police officer believes he/she has grounds for a DUI arrest, subject to a one year license suspension for refusal.
Recently, however, we have learned that some hospitals cannot achieve reliable test results on a blood sample.
Anyone receiving a DUI charge that was tested at the Grove City Medical Center may have grounds to challenge the accuracy of their blood alcohol test result. In a pending case, our firm received information under subpoena that the Grove City Medical Center flunked its proficiency test with the Department of Health by submitting test samples that were off the charts on the high side. We intend to use this evidence in Court to challenge blood alcohol tests of our clients who are facing a DUI charge in 2009. More Info |
